Completing an employer, agency, Medicaid, or AHCA incident report does not necessarily satisfy an individual's legal duty to report suspected abuse, neglect, abandonment, or exploitation to the appropriate authority.

Participants are responsible for following current Florida law, applicable regulatory and payer requirements, professional standards, and their employer's policies and procedures. Florida requirements may vary depending on the client, provider, service setting, and circumstances. When a legal reporting obligation applies, internal notification to a supervisor or completion of an incident report should not be treated as a substitute for a report required by law.

Florida law also provides certain protections, including good-faith immunity under applicable circumstances, for persons making reports concerning suspected abuse, neglect, or exploitation of vulnerable adults under Chapter 415, Florida Statutes.
